Terms of use for the “Ladeindex-geprüft” seal

§ 1 What the seal states
The seal certifies that an operator met the published criteria at the time of issue — in particular a reliability in the upper quartile of its country, a minimum number of assessed charge points and a sufficient data maturity.
The criteria in force are published on the methodology page. They form part of these terms in the version applicable at the time of issue.
The seal is not a promise about the future. It states what was measured, not what will be.
§ 2 What is granted
For the term, the Provider grants the operator a simple, non-transferable and non-sublicensable right to use the seal in its external presentation: on its website, in print, in offers and at the charging station.
A fee for use is payable where agreed in the order. The assessment itself is free of charge and independent of any fee — it arises from public data and cannot be purchased.
§ 3 How it must be used
- Unaltered. No change to shape, colour, wording or aspect ratio. Scaling down is permitted as long as the year remains legible.
- With a link. Every online use links to the verification page `/siegel/{id}`. That page shows the live status — including where the seal has since been revoked.
- With year and reference. The presentation must make clear for which period and for which unit the seal applies.
- Without extending the statement. Wording such as “best network”, “tested and recommended” or “certified to the Ladeindex standard” is not permitted. The seal says what § 1 says, and no more.
The embed code provided in the customer portal meets these requirements by itself. Anyone using it need not attend to § 3.
§ 4 Term
The seal applies for the period stated on issue, at most twelve months. It does not renew automatically; the criteria are assessed afresh for renewal.
§ 5 Revocation
The Provider revokes the seal if
- the criteria are no longer met, - the underlying data proves incorrect, - it is used contrary to § 3, or - the operator uses it in a way that goes beyond its statement.
The revocation is reasoned and communicated to the operator. Where the criteria cease to be met, the operator is first given 14 days to comment; in the case of misuse the revocation takes effect immediately.
The verification page shows the revocation within five minutes. The operator removes the seal from all of its own media within 14 days; this duty does not extend to print material already in circulation.
Any fee for the remaining term is refunded pro rata, except where revocation is for misuse.
§ 6 Rights in the mark
The mark and the designation “Ladeindex-geprüft” remain with the Provider. The right of use ends with the seal; registration of the mark by the operator, or use of confusingly similar marks, is excluded.
§ 7 Warranty
The Provider warrants the methodically correct determination of the criteria. It does not warrant that the seal will have any particular effect on customers, tenders or third parties.
The Provider is not liable for damage arising from a justified revocation. For an unjustified revocation, § 12 of the terms and conditions applies.
